Terms and Conditions
1. Acceptance of Terms
By accessing or using the MOCCA website (moccasystems.com.au) or by engaging MOCCA's services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use this website or engage our services. These Terms are governed by the laws of Queensland, Australia.
2. Services
MOCCA provides professional services including business consulting, medical copywriting, healthcare content strategy, health communications, client education materials, pharmaceutical medical writing, medical editing, and medical programme consulting. All services are provided to business clients under a separate Client Services Agreement, which governs the specific terms of each engagement. These Terms and Conditions apply to your use of this website and to general enquiries only.
3. Not Medical Advice
Nothing on this website, and nothing produced by MOCCA in the course of its services, constitutes medical advice, clinical diagnosis, or treatment recommendation for any individual. MOCCA is a professional services company, not a registered medical practice. All content produced by MOCCA is for educational, health promotion, or business communication purposes only. Individuals with personal health concerns should always consult a qualified, registered medical practitioner.
4. Intellectual Property
All content on this website, including text, design, graphics, and code, is the intellectual property of MOCCA Systems and is protected under Australian copyright law. You may not reproduce, distribute, modify, or republish any content from this website without prior written consent from MOCCA.
Project deliverables. Intellectual property in deliverables created specifically for a client project passes to the client once the fees for that project are paid in full. Until then, MOCCA Systems grants the client a non-exclusive licence to use draft deliverables for the purposes of that project. MOCCA Systems keeps ownership of its pre-existing materials, templates, tools, methods, and general know-how. Where any of these form part of a deliverable, MOCCA Systems grants the client a perpetual, non-exclusive licence to use them as part of that deliverable, including for publication. Where a signed services agreement for a project sets different intellectual property terms, that agreement applies to that project.
5. Accuracy of Website Content
MOCCA takes reasonable care to ensure the information on this website is accurate and current. However, we make no warranties or representations about the accuracy, completeness, or suitability of any information on this site. The website is provided on an "as is" basis. MOCCA reserves the right to change, update, or remove content at any time without notice.
6. Limitation of Liability
To the maximum extent permitted by law, MOCCA excludes all liability for any loss or damage — whether direct, indirect, consequential, or otherwise — arising from your use of this website or reliance on any information contained on it. This limitation does not affect any non-excludable rights you may have under the Australian Consumer Law.
7. Third-Party Links
This website may contain links to third-party websites. MOCCA does not endorse, control, or take responsibility for the content, privacy practices, or accuracy of any third-party website. Links are provided for convenience only.
8. Privacy
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this website, you consent to the collection and use of your information as described in that Policy.
9. Enquiry Submissions
Submitting an enquiry through this website does not create a contractual relationship between you and MOCCA. No engagement commences until a written Client Services Agreement has been signed by both parties. MOCCA reserves the right to decline any enquiry at its discretion.
10. Amendments
MOCCA may update these Terms and Conditions from time to time. The current version will always be published on this page with an updated effective date. Continued use of the website after any amendment constitutes acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of this website are subject to the exclusive jurisdiction of the courts of Queensland.
